Connection of existing structures to the new sanitary sewer line is mandatory. Upon completion of the construction of the sewer main along the street, property owners will be notified by mail that the sewer line is available and connection is required. Abandonment of the existing septic tank and connection to the new sewer main will be required approximately 90 days after notification.

Power failures caused by Hurricane Wilma have affected the timers on irrigation systems throughout the City. As a result, many irrigation systems are operating at incorrect times. Please check your timers to make sure your landscaping is being watered during the correct day and time, or in your absence, please be sure your lawn maintenance company adjusts the timer for you. Enforcement of watering times will be suspended until further notice, allowing time to correct this situation.

If a Condemnation Order has been posted on a structure, the structure has been inspected by a City Official and has been deemed to be unsafe for occupancy.ONCE REPAIRS ARE MADE, THE UNIT CAN BE OCCUPIED. Until the Condemnation Order is lifted, the property may only be entered for the purpose of removing personal property and/or making the property safe.

A cross-connection is any temporary or permanent connection between a public water system or consumer’s potable (i.e., drinking) water system and any source or system containing nonpotable water or other substances. An example is the piping between a public water system or consumer’s potable water system and an auxiliary water system, cooling system, or irrigation system.

A PVB is a mechanical backflow preventer that consists of an independently acting, spring-loaded check valve and an independently acting, spring-loaded air inlet valve on the discharge side of the check valve. It includes shutoff valves at each end of the assembly and is equipped with test co*cks. A PVB may be used to isolate health or nonhealth hazards but is effective against backsiphonage only.

Non-federal activities (i.e. activities that do not involve a Federal permit, license, or funding) are not affected by critical habitat designation.

Pursuant to Section 60.05, Florida Statutes, a City may take action to obtain an injunction to cease the operation of activities which constitute a nuisance at a property. The types of activities which would authorize such an action are provided in Section 823.10, Florida Statutes, and include activities such as prostitution, gambling, drug dealing, and “gang-related activity.” In order to obtain an injunction, the City would file a complaint in circuit court against the owner of the property, and must prove through the presentation of testimony and evidence that a nuisance, as defined in the statutes, exists on the property. A judge would then need to issue the order finding that a nuisance exists and granting the City’s request for an injunction to cease the rental activity on the property.

A slight possibility exists that a pathogen may contaminate a water heater and survive if the water temperature is maintained at 120°F or lower. However, since hot water directly from the water heater usually is not swallowed, this should not be a safety concern. A water temperature of 140°F for a half hour should kill virtually any pathogens in the water heater.

One (1) “open house” sign, no larger than four (4) square feet may be erected on the property line where the open house is taking place. Such sign shall be removed at the completion of the open house and during non-supervised hours. No permit is required. (City Ordinance 02-11)

Yes, all water and sewer bills are the responsibility of the property owner. We will however mail the bill to your tenant as an “in care of” addressee. The responsibility of payment belongs to the owner. If the account becomes delinquent, then the owner will be notified. An owner may request a duplicate monthly bill be mailed to him or her as well.

Property owners are responsible to maintain sidewalks and right-of-ways, and to keep all sidewalksfree of grass, weeds, or other obstructions. Property owners shall control the overgrowth of bushes that may impede or delay public access to the sidewalk. (City Ordinance 98-19)

Although Governor DeSantis signed a bill legalizing fireworks in Florida on three holidays: July 4th, New Year’s Eve, and New Year’s Day, this legislation does not supersede local regulations relating to the use of fireworks. Fireworks are not allowed on Marco Island.

Marco Island has four (4) ordinances related to fireworks:

Sec 22-32: Fire Prevention: Fireworks shall not be permitted on residential type properties or waterways adjacent to residential type properties within City limits.

Sec. 18-105: Noise: fireworks are prohibited at any time without a permit within the incorporated limits of the City of Marco Island.

Sec. 18-145: To protect beach nesting birds, fireworks are prohibited on the beaches.

Sec 34-3: In public parks, the use, carry or possession of fireworks or other explosive substances are prohibited.

The definitions of hotel, motel, and vacation rental are found in Section 509.242, Florida Statutes, as follows:

509.242 Public lodging establishments; classifications.—

(1) A public lodging establishment shall be classified as a hotel, motel, nontransient apartment, transient apartment, bed and breakfast inn, timeshare project, or vacation rental if the establishment satisfies the following criteria: 3 10-2-20

(a) Hotel.—A hotel is any public lodging establishment containing sleeping room accommodations for 25 or more guests and providing the services generally provided by a hotel and recognized as a hotel in the community in which it is situated or by the industry.

(b) Motel.—A motel is any public lodging establishment which offers rental units with an exit to the outside of each rental unit, daily or weekly rates, offstreet parking for each unit, a central office on the property with specified hours of operation, a bathroom or connecting bathroom for each rental unit, and at least six rental units, and which is recognized as a motel in the community in which it is situated or by the industry.

(c) Vacation rental.—A vacation rental is any unit or group of units in a condominium or cooperative or any individually or collectively owned single-family, two-family, three-family, or four-family house or dwelling unit that is also a transient public lodging establishment but that is not a timeshare project.

In addition, the definition of a “transient public lodging establishment” which is used to define a “vacation rental” is provided in Section 509.013(4)(a)1., Florida Statutes, and reads as follows: “any unit, group of units, dwelling, building, or group of buildings within a single complex of buildings which is rented to guests more than three times in a calendar year for periods of less than 30 days or 1 calendar month, whichever is less, or which is advertised or held out to the public as a place regularly rented to guests.”

Yes. On average, both total nitrogen and fecal bacteria counts have increased in our waterways from the past to the present, and they appear to be caused by septic systems. Most high fecal counts have occurred in the unsewered areas during the rainy season when septic systems do not work effectively. The fecal bacteria levels are 46% higher in the unsewered areas than in the waterways where central sewer service is available.

Many private businesses on Marco Island are requiring masks.

There are no travel restrictions in place. If that changes, we will alert businesses as to the requirements for essential employees.

The owner of a residence is notified via certified mail, of any infractions of their property that require a Notice of Violation (NOV). With violations that require a Magistrate Hearing, the notification will be within 10 days of the scheduled hearing.

Beaches on Marco Island are open.

Parking on residential streets is prohibited. Vehicles that are parked illegally will be ticketed and towed. The City will be fining anyone who violates our beach conduct ordinance including bringing dogs or glass containers on to the beach. Fines are $200. Groups larger than 10 are prohibited and will also be fined $200.

Governor DeSantis issued an Executive Order on March 20 prohibiting all restaurants and food establishments within the State of Florida to suspend on-premises food consumption for customers. Establishments may continue to provide delivery or take-out services.

The Collier County Department of Health has confirmed that 935have tested positive for COVID-19 who have a Marco Island address. Information related to specific cases is maintained by the Collier County Department of Health, and Federal law protects personal medical information from being released.

No. On September 25th, Governor DeSantis announced that Florida will enter Phase 3 of the State’s Reopening Plan. This means all bars, restaurants, gyms, and other businesses can operate at 100% capacity. However, the State of Florida is still under a declared state of emergency which was extended by the Governor on November 3, 2020 (EO-20-276).

Building Services

Yes. Maximum Assessment consists of an estimated cost to construct sanitary sewer lines in your area. If the actual construction costs are less than the estimate, the final assessment will be less than the Maximum Assessment provided in this notice.

Each property owner will be asked to consider prepayment in advance of construction. If a property owner decides to prepay the assessment, there will be a six percent (6%) discount from the assessment. If a property owner elects to pay the assessment over twenty (20) years, the property owner will be required to pay the assessment over the 20-year period, plus the cost of funds (interest rate on borrowed money), plus one percent (1%) each year. Therefore, your tax bill will have a Sewer Assessment equal to one-twentieth (1/20) of the assessment, plus interest, plus one percent (1%), for a period of twenty (20) years unless paid off earlier. If a property owner elects todeferpayment of the assessment for up to 20 years, payment plus accrued interest plus one percent is due at the end of the 20 years. If assessments are paid in equal installments over 20 years or if they are deferred for up to 20 years, payment plus interest is due upon transfer of property ownership.

You may park your RV in the driveway as long as it does not block the sidewalk with a City permit affixed to the vehicle in a conspicuous place. You may obtain a 7-day permit at Marco Island Police Department at no charge. You are allowed 28 days percalendar year for RV parking, however not consecutive. NOTE: All applications are required to have a City-authorized signature to be effective. (City Ordinance 01-15)

You may park your trailer (boat/sea doo/jet ski) for 8 hours for the purpose of loading, unloading or cleaning.

The State of Florida has authorized Collier County to allow vacation rental operations on May 21, 2020. On May 27, the Collier County proposal was updated and now allows for the following:

Guests occupying those vacation rentals must adhere to the quarantine restrictions or be subject to established criminal and civil penalties.

Reservations from international travelers will not be accepted.

In the event the Governor issues subsequent Orders addressing vacation rentals and /or “hot spots” in the U.S., those restrictions shall be incorporated into the plan.

The Governor has extended EO 20-80 (Airport Screening and Isolation) and 20-82 (Isolation of Individuals Traveling to Florida) directing all persons whose point of departure originates from outside the State of Florida in an area with substantial community spread, to include the New York Tri-State Area, to isolate or quarantine for 14 days from the time of entry into the State of Florida. Executive Order 20-86 (Additional Requirements of Certain Individuals Traveling to Florida, including Louisiana) is also extended under the new Executive Order 20-112.

  • On June 26, the Governor, through the Florida Department of Business and Professional Regulation (DBPR), has issued Emergency Order 2020-09 which states that DBPR is suspending the “on premises” consumption of alcohol at bars statewide. The order states:
  • All vendors licensed to sell alcoholic beverages for consumption on the premises, who derive more than 50% of gross revenue from such sales of alcoholic beverages, shall suspend the sales of alcoholic beverages for consumption on the premises.
  • Bars can continue to sell alcoholic beverages in sealed containers for consumption off premises.
  • Vendors who are also licensed as a public food service establishment, or “restaurants” may continue to operate for on-premises consumption of food and beverages at tables in accordance with E.O. 20-139, as long as these restaurants derive 50% or less of gross revenue from the sale of alcoholic beverages for on-premises consumption. (E.O. 20-139 requires restaurants to operate at 50% capacity indoors, allows for outdoor seating, and all with social distancing measures in place).
  • Effective immediately (June 26, 2020).

Groups of homeowners may decide on their own to form voluntary associations and develop covenants and restrictions as part of the formation of an association. The City would not, however, play a role in the formation of the associations, or the development and associated enforcement of any rules or regulations adopted by the association.

No permit is needed. Restaurants and food establishments may add additional outside seating beyond their currently approved capacity. All temporary outdoor seating must satisfy the following criteria:

A. If utilizing parking spaces, restaurants and food establishments may utilize up to four (4) parking spaces to provide socially distanced outdoor seating;

B. If utilizing parking spaces, in order to ensure the safety of diners there must be 30” high precast concrete Jersey style barriers, pinned to the asphalt, separating seating area from vehicle use area;

C. Restaurants may not expand outdoor seating in front of neighboring businesses without written permission from the business/property owner; and

D. Restaurants must meet all City, County, and State requirements for a restaurant use.

The City of Marco Island may revoke a restaurant's temporary outdoor dining for failure to comply with these criteria, or failure to follow CDC social distancing guidelines. The temporary expansion of outdoor seating shall remain in effect until the State of Florida permits restaurants and food establishments to operate at one-hundred percent (100%) of their approved occupancy, or unless cancelled or modified by the City of Marco Island.

Prior to securing financing for your district, you will be offered a six percent (6%) discount for prepayment of the assessment amount associated with each parcel. With prepayment, there will be no annual assessment placed on your property tax bill.

Yes. The police department issues citations if there is a violation of the noise ordinance. The noise ordinance applies to single-family residences as well as single-family residences that are operating as vacation rentals.

No. The vacation rental license is issued by the state Department of Business and Professional Regulation (“DBPR”). The DBPR is the state agency that can suspend or revoke a license.

No. Section 509.032(7)(a), Florida Statutes states that “A local law, ordinance, or regulation may not prohibit vacation rentals or regulate the duration or frequency of rental of vacation rentals.”

A vacation rental registration ordinance would apply to any residence that meets the criteria for a vacation rental as contained within the City’s registration ordinance. Ordinances related to noise, parking, landscaping, and other site related regulations would apply to both vacation rentals as well as other residential properties.

Stat. the owner/operator of the transient lodging establishment can provide notice to the occupant, in writing as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this state.”

In 2009, the planning board conducted two public hearings on the issue of vacation rentals. In 2014, the planning board took up the issue again and conducted public hearings. In 2015, the City Council passed an ordinance requiring registration, inspections, fees, occupancy limits, and parking registration for guests. This ordinance was passed by the Council in May 2015 and was rescinded in October 2015. In late July 6 10-2-20 2020, the City Manager developed a cross-department team to research the issues surrounding vacation rentals. Staff established a special email to receive public comment. We presented research and findings to the community in a September virtual meeting. The City Council will hear staff recommendations in October 2020.

This advisory outlines who is eligible to receive a COVID-19 vaccine, and provides clear direction and proof-of-residency requirements for all entities administering the vaccine in Florida.

If you live in a condominium you need a contractor. If you own and occupy your one or two-family house you may be eligible to act as your own contractor per State statute (489.103(7). As an owner builder though, if you do not complete all of the work yourself, you must supervise the work, and hire licensed trade subcontractors (electrician, plumbing, a/c, and roof) in accordance with state law. Owners acting as their own contractor are required to personally appear for all permitting. You must provide proof that the property is insured and you must be present for all inspections.

Currently, the Florida Fish & Wildlife Conservation Commission is monitoring the piping plover on Sand Dollar Island (a state-designated “Critical Wildlife Area”) and the large sandbar below Cape Romano. Both areas are posted with signs and tape. Mr. Ted Below of the National Audubon at Rookery Bay National Estuarine Research Reserve monitors piping plovers throughout Collier County. He has only encountered the piping plover wintering habitat in mud-, algae-, sand-flats and lagoons such as the Tigertail Beach/Sand Dollar Island area of Marco Island. Rookery Bay has posted Coconut Island due to the nesting least terns (threatened species) but they have also observed a few piping plovers wintering at this location. The principal area where the greatest amounts of plovers have been observed wintering is on Sand Dollar Island. I am not aware of any other studies by Everglades National Park, etc.

The sewer is made up of the base rate, presently $29.32 for a typical homeowner on Marco Island and $5.79 per thousand gallons of usage up to 6,000 gallons of use, which equals a maximum sewercharge of $34.74 for Marco Customers. *rates effective 11/01/19

The US Fish & Wildlife Service’s critical habitat designation will not “rope off” any areas proposed. Although, Sand Dollar Island is currently roped off by the State for its Critical Wildlife Area, so designated to protect concentrations of species that are endangered of extinction. This area does contain the highest concentration of piping plovers wintering on Marco Island, hence they would be protected in an already “roped off” area. The State Wildlife Officers currently monitor and have the authority to protect this area. The Marco Island Utilities Business Plan provides for the creation of a master plan for the construction of sewers throughout the City. The Plan calls for the installation in phases over seven years for several reasons. As sewer construction projects can be fairly disturbing to neighborhoods, construction will be planned in phases to minimize citywide disruptions. The geography of an area influences the geographic boundaries of each assessment district. The districts were created in a logical sequence for the wastewater system expansion. There is not sufficient sewer force main and sewer treatment capacity to handle the additional sewage flow if all properties are connected at the same time. Capacity of the wastewater treatment plant will be expanded beginning next year.

Many cities in the state of Florida are having similar issues with vacation rentals, however, cities like Naples and Sanibel had ordinances in place prior to June 1, 2011 that allow them greater leverage over regulating vacation rentals. Other cities like Fort Myers Beach and the City of Largo have instituted registration requirements. We 4 10-2-20 researched several counties and cities to determine best practices and processes that work within other jurisdictions.

In order for a condemnation order to be lifted the following provisions must be met:

  • Repair and/or dry all ceilings, walls, and carpets, and cover exterior wall openings and/or roofs with plywood or plastic sheeting to secure the interior from the elements.
  • A statement from an electrical contractor that the unit has been inspected and is safe to occupy if the electrical system has been damaged or compromised by moisture is required (a sample copy of a contractor’s statement is attached).

Building Services has sample affidavits that contractors can sign. We request that property owners use temporary stabilization measures to avoid imminent building or structure collapse. A City Official will inspect the property and remove the condemnation order. A certificate of re-occupancy will be issued by the Building Services Division.

A permit application expires 180 days after the date of filing from approval date (105.3.2). Depending on workload, and all required documents are provided, a Building Permit can be obtained within 10-15 workdays. Minor projects are normally approved, or additional information requested, within 5 workdays. There are also over-the-counter permits such as reroofs and a/c replacements.

Vigorous boiling for at least one full minute is the safest and most effective method of water disinfection. Fill a pan or pot with cold water, and start timing when steady streams of bubbles pop from the bottom of the pan. Be careful lifting heavy pots and pans, and cool the water before using it for washing or tooth brushing. Store the disinfected water in clean, covered containers. Using bottled water is an option.

At the time that there is a change in title, whether transferred or sold, the fine is usually paid by the new owner in order to remove the lien. If a citation is paid without the violator contesting and no hearing is required, then it is recorded as a fine paid by the City’s finance department. If the citation is contested or the individual is asked to appear at a Magistrate Hearing, then the amount becomes a fine when an order is issued so that the individual is afforded due process.

Screen Enclosures with 25% or more damage should be completely removed. Screen enclosures may be demolished without a permit. Once a screen enclosure has been removed from a pool, the pool should be protected with a barrier. This can be done with an approved fence or screen enclosure. Orange safety fencing can be installed, temporarily, to protect the pool. If permanent pool barriers are installed, they should be at least 4 feet high, on the outside, with a self closing, self locking, gate or door, with a latch that is at least 54 inches high. If permanent fencing or a screen enclosure is installed, it must be permitted by a licensed contractor or an owner builder who meets the requirements of the City Ordinance.

If only the GLASS is replaced, it may be replaced with like materials, without a permit. If the entire window unit (glass and frame) is replaced, it must meet the current codes for wind and impact.* In a single family home, if less than 25% of the opening area is being replaced, the impact requirement is not applicable. Marco Island Utilities is considering a new water rate schedule designed to reward those who conserve water while penalizing those with high water consumption. The conservation rates will be in “blocks,” with lower rates for lower consumption and higher rates for higher consumptions. Customers will be informed in advance of any proposed changes to the rate structure.

The City of Naples has already replaced their septic tanks. Cape Coral is in the process of expanding its central sewer system to all properties. The City of Sanibel is replacing septic tanks with a central sewer system. Monroe County (Key West) is eliminating septic systems.

Current Utility Rate Schedule

It depends on the specific violation. In Section 1-14 of the City of Marco Island Code of Ordinances, repeat violations are subject to (i) a fine of up to $500.00 per violation per day for continuing repeating violations; (ii) by civil citation up to $500.00 per offense; (iii) by the seeking of injunctive relief through the courts; or (iv) any combination thereof. Each incident of violation shall constitute a separate and distinct violation of the article.

Septic systems, new or old, maintained or not, are simply not designed or installed to adequately protect our waterways. They do not adequately treat pollutants such as fecal matter, viruses, and pharmaceuticals, which are health issues, and nutrients, such as nitrogen, which create aquatic growth such as algae blooms, darken our waters, and deplete fish life. Septic system effluent migrates from our yards to our waterways. Because of the high water table on Marco Island during the rainy season and the close proximity of septic systems to our waterways, there is inadequate earth filtering space to treat fecal matter before it enters our waterways.

Septic tanks convert fecal matter, urea, and other wastes into a sludge that remains in a tank. Liquid is then conveyed through the yard and ground through perforated plastic pipe and drain fields, usually in the front yard. Biological activity takes place in the tank and yard, but as sludge in the tank builds up, biological activity is reduced. Seasonal use of septic systems, common on Marco Island, limits effective treatment. It takes about 30 days to develop biological treatment when a home is vacant for a period and then reoccupied. During this time, little sewage treatment is achieved. Septic systems work best in rural areas that have low density, more land, and are further from lakes, rivers, and the coastal estuarine.

Many septic systems do not operate properly during the summer months when the ground water table is higher. Often, the water table is at or above the drain field in the yard. Human waste then leaks into the soils, ground water, and surrounding areas.

The following is a summary of several scientific reports on the influence of septic systems on adjacent waterways, and the potential health hazards relating to septic tanks in coastal areas. Fecal coliform is higher in waterways adjoining areas with septic systems, and they are twice as high during the rainy season. Fecal coliform, nitrates, and phosphates present in septic systems are responsible for such diseases as shigellosis, typhoid fever, gastroenteritis, and blue baby syndrome.

Ground water contamination via septic tanks is a nation-wide problem but is more prevalent in coastal areas. Studies demonstrate rapid movement of viruses from septic tanks into nearby coastal waters. Infectious enteroviruses were detected throughout the study area, indicating a widespread contamination problem. Properly functioning septic systems remove very little nutrients and effluent can rapidly migrate to surface waters. Sewage discharge from septic tanks is a source of nutrients and human pathogens to ground and surface waters. Septic systems lead to contamination of the marine surface waters.

On average, 40% of septic tanks do not function properly. The major problem is that they contain significant amounts of bacterial and viral pathogens which can and do pose a significant health risk.

Use boiled or bottled water to brush your teeth, but tap water is fine for bathing, showering and shaving. Avoid getting water in your mouth, eyes and nose, and keep an eye on children in the bathtub. People with recent cuts, surgical wounds, immunity problems or chronic illnesses may consider using boiled water for bathing. Parents may want to use water that has been boiled and cooled to bathe newborns and young infants.

Your sanitary sewer assessment will be the sum of the cost of these two improvements and represents the capital cost of the improvements.

Wastewater Treatment Capacity Improvements (“capacity cost”) include planning, engineering, and construction of other wastewater facilities that may not be within your district, but must be expanded to accommodate additional sanitary waste. There is no ordinance in reference to the number of garbage containers that a property may have. The ordinance dictates time frames when the containers can be placed at the curb and where the receptacles must be kept.

It has been announced that all Americans would be eligible for a third dose of either the Pfizer or Moderna vaccine beginning mid to late September. It is important to note that this must go through the FDA approval process and the CDC approval process. At that point, DOH will receive guidance as to how and who to administer the vaccine to. It is anticipated that the third dose roll out will mirror the initial vaccine roll out – those over 65, healthcare workers, and nursing home residents receiving the third dose first.

At this time, those who are moderately to severely immunocompromised are eligible for a third dose. This includes:

Those who are receiving active cancer treatment

Organ transplant recipients who take medicine to suppress the immune system

Stem cell transplant recipients in the last two years

Advanced or untreated HIV

Active treatment with high-dose corticosteroids or other immunosuppressants

A boil water notice means tap water should not be used for drinking, cooking or icemaking until tests verify the water is safe. Tests typically take 48 hours. In the meantime, tap water should be boiled to kill any microorganisms that may be present.

The Executive Order says that senior citizens (65+) and individuals with a significant underlying medical condition shall stay home. The Order also lists essential activities. It is in effect from April 3 – 30. The entire Order is on our website www.cityofmarcoisland.com/emergency.

The list of required inspections is located on the bottom of the permit placard. Instructions on scheduling these inspections will be provided when your permit is issued. It is the applicants (Owner-Builder/Contractor) responsibility to ensure that all required inspections are made prior to proceeding with work on the project. For new dwellings, once all fees are paid and all required inspections are completed, the applicant will be issued a CO (Certificate of Occupancy). Or, a COC (Certificate of Completion) can be obtained for all other permit types.

Building & Zoning Code Compliance will issue an advisory notice. Once a permit is obtained, the cost will be quadrupled for an After the Fact permit. Additionally, there may be fees for a third party engineering analysis if areas of work are concealed. If no action is taken, a Notice of Violation will be issued and could result in fines being levied.

An existing septic tank must be cleaned and either removed or broken in place and filled with sand or other acceptable materials. To do so requires a permit from the State Health Department and the City. A sewer line will need to be installed from an existing home and connected to the sewer main in front of the property. This work is performed by a licensed plumbing contractor and a certified septic tank removal contractor. The costs may vary, depending upon the amount of landscaping that must be removed or relocated. An estimated cost is in the $2,000 range.

To ease the burden on the homeowner, Marco Island Utilities will propose a “turnkey” alternative. As the sewer lines are constructed and ready for service on a street, Marco Island Utilities will pre-qualify plumbing contractors and negotiate a price to connect the home to the sewer main. The costs may vary, depending upon the amount of landscaping that must be removed or relocated. An estimated cost is in the $2,000 range.

A backflow preventer is a means or mechanism to prevent backflow. The basic means of preventing backflow is an air gap, which either eliminates a cross-connection or provides a barrier to backflow. The basic mechanism for preventing backflow is a mechanical backflow preventer, which provides a physical barrier to backflow. The principal types of mechanical backflow preventer are the reduced-pressure principle assembly, the pressure vacuum breaker assembly, and the double check valve assembly. A secondary type of mechanical backflow preventer is the residential dual check valve.

The block rate is conservation average with consideration to your lot size. The larger the lot the higher the allocation of water. The residence are broke down into 5 allocations we call tiers. An rdc is effective against backpressure backflow and backsiphonage but should be used to isolate only nonhealth hazards and is intended for use only in water service connections to single-family homes.

An air gap is a vertical, physical separation between the end of a water supply outlet and the flood-level rim of a receiving vessel. This separation must be at least twice the diameter of the water supply outlet and never less than one inch. An air gap is considered the maximum protection available against backpressure backflow or backsiphonage but is not always practical and can easily be bypassed.

AnERCis an ‘equivalent residential connection’ that generally represents the usage requirements of a single-family residential customer for a home with less than 2,500 square feet. ERC is the basis to compute sewer assessments. Each home built before June 1, 2005 is considered to be one (1) ERC (even though it may be larger than 2,500 square feet). A commercial property may have more than one ERC depending upon the commercial use of the property. For vacant properties or for existing homes that are expanded in the future, there may be an additional ERC cost that must be paid upon issuance of a building permit. For instance, a single-family home constructed after June 1, 2005 that is greater than 2,500 air-conditioned square feet is assessed one (1) ERC for the first 2,500 square feet and an additional 0.33 ERC for each 700 square feet thereafter.

Backflow is the undesirable reversal of flow of nonpotable water or other substances through a crossconnection and into the piping of a public water system or consumer’s potable water system. There are two types of backflow--backpressure backflow and backsiphonage.

Backpressure backflow is backflow caused by a downstream pressure that is greater than the upstream or supply pressure in a public water system or consumer’s potable water system. Backpressure (i.e., downstream pressure that is greater than the potable water supply pressure) can result from an increase in downstream pressure, a reduction in the potable water supply pressure, or a combination of both. Increases in downstream pressure can be created by pumps, temperature increases in boilers, etc. Reductions in potable water supply pressure occur whenever the amount of water being used exceeds the amount of water being supplied, such as during water line flushing, fire fighting, or breaks in water mains.

Backsiphonage is backflow caused by a negative pressure (i.e., a vacuum or partial vacuum) in a public water system or consumer’s potable water system. The effect is similar to drinking water through a straw. Backsiphonage can occur when there is a stoppage of water supply due to nearby fire fighting, a break in a water main, etc.

Many who leave their home or condominium for extended periods wonder why they are charged for water when no water was used. There are costs associated with having that water available when you are ready to use it. The treatment plants and water distribution system must always be ready to deliver water on demand, and utility systems must be able to deliver on peak consumption days as well as during the off-season if necessary. The cost of this required plant capacity is partially recovered through the base charge. Even if a customer uses no water in July, for example, there will always be a base charge but no “volume” charge. Reputable landscape irrigation firms can assess the effectiveness of your irrigation system.

We do not have a billing budget due to the high fluctuations in customer’s water bills. This fluctuation is due to varying sprinkler settings, and to the amount of rain received.

According to the CDC, isolation separates sick people with contagious disease from people who are not sick. Quarantine separates and restricts the movement of people who may have been exposed to a contagious disease to minimize the potential spread.

Water suppliers usually do not have the authority or capability to repeatedly inspect every consumer’s premises for cross-connections and backflow protection. Alternatively, each water supplier should ensure that a proper backflow preventer is installed and maintained at the water service connection to each system or premises that poses a significant hazard to the public water system. Generally, this would include the water service connection to each dedicated fire protection system or irrigation piping system and the water service connection to each of the following types of premises:

  1. premises with an auxiliary or reclaimed water system;
  2. industrial, medical, laboratory, marine or other facilities where objectionable substances are handled in a way that could cause pollution or contamination of the public water system;
  3. premises exempt from the State Plumbing Code and premises where an internal backflow preventer required under the State Plumbing Code is not properly installed or maintained;
  4. classified or restricted facilities; and
  5. tall buildings. Each water supplier should also ensure that a proper backflow preventer is installed and maintained at each water loading station owned or operated by the water supplier.

Residential single-family: 1.5 square feet; residential multi-family: Four (4) square feet; non-residential: Four (4) square feet. Maximum height is three (3) feet as measured from finished grade around the base of the sign. (City Ordinance 02-11)

If an electric sign has been damaged and the frame (or can) is still present, a business owner may cover it with a banner sign or plywood sign. If a non-electric sign has been damaged it may be replaced with a 4ft. x8ft. or 32 sq. ft. ground sign.

Moderna

A local ordinance with a registration process that designates vacation rentals as a business (or home occupation) and requires a fire inspection in order to receive a local permit. The registration process could provide for limitations on the number of guests per square feet in the vacation rental, and could impose a fine for violating the occupancy limits.

The intent of a local registration would be to identify vacation rental property owners, have the owners provide an emergency point of contact, be able to conduct life safety inspections, ensure the property is properly licensed with the state Department of Business and Professional Regulation, and ensure taxes are being collected by the County.

An identification system is a software program that the City could purchase from a private company that compiles the address, owners’ names and contact information for vacation rental properties. It provides features to be able to communicate with the owners, a 24/7 hotline, a complaint tracking system, and more, depending on what modules are purchased. A registration system would be set up by the City requiring vacation rental property owners to register their property with the City and receive a license or permit. The City Council would determine which of these options the City would undertake.

Per Florida Building Code (102.2), a permit shall apply to the construction, erection, alteration, modification, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every public and private building, structure or facility or floating residential structure, or any appurtenances connected or attached to such buildings, structures or facilities.

Water service can be terminated if account is delinquent for 60 days or more of the due date.

When the pressure in lines that transport potable water falls below 20 pounds per square inch, a boil water notice is issued as a precaution, even when contamination is unlikely. Any loss in water pressure creates the possibility of harmful bacteria entering the lines. Until laboratory tests are completed to confirm the water has not been contaminated, the boil water notice remains in effect.

The police department is very proactive. With code violations, the police department self generates 6 times as many calls for service than those they are dispatched to.

The operation of a vacation rental property is a business. The activity that takes place at a vacation rental, however, is residential in nature. That is why a local government cannot necessarily regulate the rental of a single family home being utilized as a vacation rental as a business. Unless the activity at the location of the vacation rental consists of business transactions, the delivery of supplies and inventory, or the carrying on of business activity, the activity occurring at a vacation rental can be similar to what takes place at any other residence, and is not subject to regulation as a business. Beside “home occupations” by right as and accessory use, the City also allows private schools, adult daycare, childcare, and group care facilities as a Conditional Use in residential districts.

The City’s code Sec. 30-81 identifies the intent and purpose of residential single-family dwelling (RSF) districts. It also lays out accessory uses, and conditional uses allowed in these districts, including home occupations. While “home occupation” uses does not include vacation rentals, the land development code (Sec. 30-404) does not clearly prohibit rentals in a RSF district.

In some areas the lots are smaller than in other areas. Therefore, the cost to serve smaller properties may be less than areas where the lots are larger and where more lineal feet of sewer mains are required. The geography of some areas may require more or less sewer pump stations used to transport sewage through the force mains. The estimated cost for each district cannot be determined until detailed engineering plans have been prepared with estimated construction costs at that time. Construction costs may vary from year to year. Because Florida Statutes require that property owners be informed of the “maximum assessment” it is important that reasonable estimates be derived after final engineering plans have been completed for each project area. To obtain construction bids for seven years into the future, contractors will likely factor in such a high contingency as to make the program financially impractical.

Pursuant to Florida Building Code (FBC) 101.2, single-family homes are excluded from the provisions of the Florida Building Code - Building (FBC-B). Single-family homes must, instead, comply with the provisions found in the Florida Building Code – Residential (FBC-R). The FBC-R does not contain occupant load limits. Pursuant to Section 633.208(8)(a), Florida Statutes, the provisions of the Life Safety Code, as contained in the Florida Fire Prevention Code, do not apply to one-family and two-family dwellings. Therefore, the Fire Department has no authority to enter these structures to conduct any inspections, outside of a Fire or Medical Emergency. 2 10-2-20 Also, the City of Marco Island Land Development Code only regulates density, not occupancy.

The City is also limited in its ability to limit the number of individuals who reside in a dwelling. The ability to place a specific limitation on the number of individuals who can reside in a home is limited by the Fair Housing Act, and potential discrimination claims due to treatment of different “family” groups. If the City were to place a specific numerical limit on the number of individuals who can reside in a home, the City could be subject to a claim of discrimination if a “family” were to be cited for exceeding the specific number of individuals permitted to reside in a residence.

Formal recommendations will be made to City Council at their meeting on 10/5/20. The purpose of the virtual community meeting was to hear from the community in order to determine the best recommendations for Council.

Mechanical backflow preventers have internal seals, springs, and moving parts that are subject to fouling, wear, or fatigue. Also, mechanical backflow preventers and air gaps can be bypassed. Therefore, all backflow preventers have to be tested periodically to ensure that they are functioning properly. A visual check of air gaps is sufficient, but mechanical backflow preventers have to be tested with properly calibrated gauge equipment.

The Florida Building Code (101.3) states that the purpose of the code is to establish the minimum requirements to safeguard the public health, safety and general welfare through structural strength, means of egress facilities, stability, sanitation, adequate light and ventilation, energy conservation, and safety to life and property from fire and other hazards attributed to the built environment and to provide safety to fire fighters and emergency responders during emergency operations.

Some cities had ordinances in place prior to 2011 so they are “grandfathered” and not limited by current Florida statue. Other cities that we researched have requirements in place as part of a local permitting and registration process. However, local governments cannot prohibit vacation rentals, even if the owner refuses to register locally.

Backflow into a public water system can pollute or contaminate the water in that system (i.e., backflow into a public water system can make the water in that system unusable or unsafe to drink), and each water supplier has a responsibility to provide water that is usable and safe to drink under all foreseeable circ*mstances.
